These Terms of Service ("Terms", "Agreement") govern your use of the AI voice agent reservation service provided by Al Maxy Innovation And Artificial Intelligence Research And Consultancies FZ-LLC ("we", "us", or "our"), including the website https://www.aimaxy.net and all related software, APIs, and documentation (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
1. Definitions
- "Customer" means the hotel, hotel group, or other hospitality business that registers to use the Service.
- "Guest" means an individual who makes a reservation via the Service.
- "Service" means the AI voice agent platform that answers reservation calls, processes bookings, and integrates with Property Management Systems (PMS) such as Opera PMS.
- "Permanent Email Address" means the never-expiring email address created for each Guest (e.g., [whatsapp_number]@mail2w.com).
2. Eligibility and Account
By using the Service, you represent that you are at least 18 years old and have the authority to bind your hotel or organization. To access the Service, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Description of Service
Our Service provides an AI-powered voice agent that:
- Answers hotel reservation calls 24 hours a day, 7 days a week.
- Supports 12+ languages, auto-detecting the guest's language.
- Processes booking requests, including room selection, dates, upsells, and special requests.
- Automatically creates a permanent email address for each Guest (linked to their WhatsApp number).
- Confirms bookings directly into your PMS (e.g., Opera PMS) with zero manual entry.
- Sends booking confirmations and notifications to the Guest's WhatsApp/email.
4. Pricing and Payment
- Partner: 14% – Independent hotels
- Premium: 12% – Multi-property groups (10+ hotels)
- Enterprise: 11% – Chain of 50+ properties
- Global: 9% – Global chain of 1,000+ properties
You pay nothing unless a booking is confirmed. No setup fees, no hidden costs.
All fees are exclusive of applicable taxes. Payment is due within 30 days of invoice. We reserve the right to suspend the Service for overdue payments.
5. Customer Responsibilities
As a Customer, you agree to:
- Provide accurate and complete information when registering.
- Maintain the security of your PBX/SIP integration credentials.
- Comply with all applicable laws, including data protection regulations (GDPR, etc.).
- Not use the Service to transmit any unlawful, harmful, or infringing content.
- Not reverse engineer, modify, or attempt to gain unauthorized access to the Service.
6. Permanent Email Address Feature
For each Guest booking, we automatically create a permanent email address linked to the Guest's WhatsApp number. You (the hotel) may send booking confirmations, pre-arrival instructions, and post-stay communications to this address. You are responsible for ensuring that your use of the permanent email address complies with applicable data protection laws.
7. Intellectual Property
The Service, including its software, algorithms, trademarks, and content (excluding Customer Data), is our exclusive property. We grant you a limited, non-exclusive, non-transferable license to use the Service during the Term.
8. Data Processing and Privacy
Our collection and use of personal data is governed by our Privacy Policy. For Customers located in the EEA, we offer a Data Processing Agreement (DPA) upon request, incorporating EU Standard Contractual Clauses.
9. Warranties and Disclaimers
The Service is provided "AS IS" without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to us in the 12 months preceding the claim. In no event shall either party be liable for any indirect, incidental, special, or consequential damages.
11. Term and Termination
These Terms commence on the date you first use the Service and continue until terminated by either party. Either party may terminate for material breach upon 30 days' written notice if the breach remains uncured.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates.
